A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face human smuggling charges, he was detained in immigration detention.

In her order, the judge noted that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
