The former personal attorney for Donald Trump has stepped down as the US Attorney for New Jersey. This comes after a court battle that invalidated her eligibility to occupy the role.
Acceptance of Resignation
US Attorney General, Pam Bondi, confirmed Habba's resignation on the start of the week. She commented that the appeals court finding made it unworkable for her to effectively run her office.
"Do not interpret compliance for surrender," she wrote. "The effort will now extend throughout the country."
Court Ruling
Her resignation comes a week after a US appeals court found that she had been acting without proper authority as the top prosecutor. This decision is could influence scores of criminal cases in New Jersey.
The judicial panel declared that a temporary posting that did not receive Senate approval violated the Federal Vacancies Reform Act.

The Attorney General added that she will remain at the DOJ as a high-level advisor. Habba plans to challenge the decision of the ruling, aiming for a different outcome.
Writing online, the Attorney General wrote that judges "must not countermand the President's choice of prosecutors entrusted with performing the primary duty of the administration of criminal prosecution."

The attorney general praised the prosecutor's work and said that during her run, the city of Newark saw a significant drop in offenses. Additionally that the Camden experienced its first summer in half a century with no murders.
Legal Career
The 41-year-old attorney, first joined Donald Trump's lawyers in recent years. Subsequently, she defended the former president in his business records case in New York last year, which resulted in his conviction on 34 counts of falsifying business records.
Earlier, her appointment to the federal prosecutor position, the former president had announced he was selecting her as his senior adviser in a potential future term, calling Habba as a steadfast ally and a "tireless advocate for justice".
